Privacy policy

Inka Products attaches great importance to the protection of your personal data. This policy explains which data we collect on the website www.produitsperuviens.com, why, how long we keep it, who we share it with and how to exercise your rights, in accordance with the General Data Protection Regulation (GDPR, EU Regulation 2016/679) and the amended French Data Protection Act of 6 January 1978.

1. Data controller

2. Data collected and purposes

  • Orders: last name, first name, delivery and billing addresses, email, phone number (optional), items ordered. Purposes: processing and delivering your order, issuing the invoice, handling returns and customer service. Legal basis: performance of the contract and legal obligations (accounting).
  • Customer account: email, last name, first name, password (stored encrypted, we do not know it), date of birth (optional), addresses. With "Continue with Google", Google only sends us your email, first name and last name. Purpose: letting you follow your orders and order faster. Legal basis: performance of the contract.
  • Payment: your card details are entered directly with Stripe or PayPal; we neither receive nor keep them. Legal basis: performance of the contract.
  • Contact form: name, email, order number, message. Purpose: answering your request. Legal basis: legitimate interest in answering requests.
  • Audience measurement (Google Analytics), only if you accept it in the cookie banner. Legal basis: consent.
  • Security: IP address and pages viewed in the technical logs of the server; anti-bot protection (Google reCAPTCHA) on the account and contact forms. Legal basis: legitimate interest in securing the website.

We do not send newsletters and we never sell or rent your data.

3. Retention periods

  • Orders and invoices: 10 years (accounting obligation, article L123-22 of the French Commercial Code).
  • Customer account: until you delete it, or deleted after 3 years without login or order.
  • Cart not ordered: deleted after 8 days; unpaid order: cancelled after 6 hours.
  • Contact form messages: 3 years after our last exchange.
  • Technical logs of the server: 12 months at most.
  • Cookies: session and cart 7 days; cookie choice 6 months; Google Analytics 13 months at most.

4. Recipients and processors

Your data is processed by Inka Products and by the following providers, each for its own task:

  • ALWAYSDATA (Paris, France): hosting of the website and the database, sending of emails (order confirmations, invoices).
  • Amazon Web Services EMEA (Luxembourg), servers in Ireland: storage of the website images and the PDF invoices.
  • Stripe Payments Europe (Ireland) and PayPal (Europe) S.à r.l. et Cie (Luxembourg): payment.
  • La Poste / Colissimo (France): delivery and parcel tracking (name, address, phone number).
  • Google Ireland (Ireland): sign-in with Google if you choose it, audience measurement (Google Analytics) with your consent, anti-bot protection (reCAPTCHA).
  • French National Institute of Geographic and Forest Information (IGN, France), Base Adresse Nationale: address suggestions while you type, queried by our server (your IP address is not sent to it).

Some of these providers (Stripe, PayPal, Google) may transfer data outside the European Union, in particular to the United States, under the Data Privacy Framework or the standard contractual clauses of the European Commission.

5. Cookies

The cookies needed for the website to work (session, cart, language, form security, payment) are set without consent. Audience measurement cookies are only set with your consent, which you can change at any time with the "Cookie settings" link at the bottom of every page.

6. Your rights

You have the right to access, rectify and erase your data, to restrict and object to its processing and to data portability, as well as the right to give instructions on what happens to your data after your death. From your account you can directly change your information, download your data and delete your account. For any other request, write to contact@inka-products.com; we answer within one month. An identity document will only be requested if there is reasonable doubt about your identity.

If you consider that your rights are not respected, you can lodge a complaint with the CNIL, the French data protection authority (www.cnil.fr/fr/plaintes), or with the data protection authority of your country.

7. Security

The website is only available over HTTPS, passwords are stored encrypted and access to the data is limited to the people who need it.
